Canadian Board Co. WARRANTY POLICIES

UPON RECEIPT OF PRODUCT, PLEASE INSPECT AND REPORT ANY MANUFACTURER DEFECTS.

Canadian Board Co. supplies a non-transferable, limited warranty (the “Limited Warranty”) to the original consumer-buyer (“You, “Your” or “Buyer”) of Canadian Board Co. products against material manufacturer defects arising under normal use of the purchased products (with respect to paddle boards, “Paddle Board Products,” and accessories, “Accessory Products,” and together with Paddle Board Products, “Products”). This Limited Warranty is subject to the following terms and conditions. PLEASE NOTE THAT SOME ITEMS ARE EXCLUDED FROM THE FOLLOWING LIMITED WARRANTIES. THESE ITEMS ARE DISCUSSED AT THE END OF THIS DOCUMENT.

LIMITED WARRANTY DURATION:

• 3 YEARS from date of purchase inflatable paddleboards, inflatable docks, and planks

• 1 YEAR from date of purchase on Electric Pumps and all other electronic items

• 1 YEAR from date of purchase on Accessory Products included with SUP package 

• 30 DAYS from date of purchase on Kanuk Board Co. Products

LIMITED WARRANTY ON PRODUCTS COVERS MATERIAL MANUFACTURER’S DEFECTS ONLY, INCLUDING:

• Seam leaks

• Valve Leaks

• Improper Construction


LIMITED WARRANTY ON PADDLE BOARD PRODUCTS DOES NOT COVER DAMAGE FROM THE FOLLOWING CATEGORIES:

• Misuse of the Products.
• Products that were lost or stolen.
• Damage caused by impact to rocks, docks, shore-pound, boat damage etc.
• Damage caused by normal wear and tear.
• Damage or defects caused by inappropriate storage in temperatures over 27°C and under -5°C.
• Indents/texture on the PVC that is a result of the drop stitching construction.
• Damage caused by transportation
• Damage to fin or fin box caused by impact to the fin.
• Damage caused by overexposure/storage in direct sunlight.
• Damage caused by mishandling, whether or not that mishandling is caused by the Buyer, including without limitation: airline travel, improper loading/unloading into trucks, rolling or dragging on concrete, shipping, etc.
• Acts of God, fire, or casualty.
• Failure to exercise normal maintenance.
• Consequences of uses for which the Product was not designed.
• Damage to the valve caused by loosening the valve to deflate.
• Uses of a Product in ways, including any aftermarket modifications made to the item, other than as expressly provided by the instruction manual or any other documentation accompanying the Product.

LIMITED WARRANTY ON ALL OTHER PRODUCTS DOES NOT COVER DAMAGE FROM THE FOLLOWING CATEGORIES:

• Misuse of the Accessory Products.
• Accessory Products that were lost or stolen.
• Accessory Products used for commercial purposes.
• Damage due to falling on the paddle.
• Paddle filling with water.
• Accessory Products sinking.
• Damage caused by use of Accessory Products outside of their intended purpose.
• Damage due to normal wear and tear, chips, cracks etc.
• Damage caused by impact to rocks, docks, shore-pound etc.
• Color fading.
• Acts of God, fire, or casualty.
• Failure to exercise normal maintenance.
• Consequences of uses for which the Accessory Product was not designed.
• Damage caused by mishandling, whether or not that mishandling is caused by the Buyer, including without limitation: airline travel, improper loading/unloading into trucks, rolling or dragging on concrete, shipping, etc.
• Uses of an Accessory Product in ways, including any aftermarket modifications made to the Accessory Product, other than as expressly provided by the instruction manual or any other documentation accompanying the item.

LIMITED WARRANTY PROCESS – SOLE AND EXCLUSIVE REMEDY:

IN THE EVENT OF A BREACH OF THE LIMITED WARRANTY, CANADIAN BOARD CO. ENTIRE OBLIGATION AND LIABILITY TO THE BUYER, AND THE BUYER’S SOLE REMEDY, IS AS FOLLOWS :

CANADIAN BOARD CO. reserves the right, in its sole discretion, to repair or replace any Products deemed acceptable by CANADIAN BOARD CO., in its sole discretion, for a warranty claim. The Buyer will pay all shipping costs associated with sending items in for repair or replacement. To make a warranty claim, please email : info@canadianboardco.com with:(1) a proof of purchase and delivery; (2) a written summary of the defect; (3) a picture of the defect, serial number located on the paddle board; and (4) a name, phone number, and return mailing address.  The buyer must contact info@canadianboardco.com before making any return based on a material manufacturer defect or in connection with a Product Limited Warranty claim.
Any Product that has not been the subject of a Limited Warranty claim using the process set forth above, within the time period stated within this document, will be deemed to conform to the Limited Warranty and deemed accepted by the Buyer.

 *WHEN REGISTERING YOUR PRODUCT FOR YOUR LIMITED WARRANTY YOU ARE AGREEING TO THE POLICY STATED ABOVE.

WARRANTY DISCLAIMER FOR ALL PRODUCTS

OTHER THAN AS EXPRESSLY SET FORTH HEREIN, CANADIAN BOARD CO. EXPLICITLY DISCLAIMS ANY EXPRESS OR IMPLIED WARRANTIES WITH RESPECT TO ANY PRODUCTS. SUCH DISCLAIMED WARRANTIES INCLUDE, BUT ARE NOT LIMITED TO, WARRANTIES OF NON-INFRINGEMENT, MERCHANTABILITY, AND FITNESS FOR A PARTICULAR PURPOSE. SOME STATES DO NOT ALLOW LIMITATIONS ON HOW LONG AN IMPLIED WARRANTY LASTS, SO THE PRECEDING LIMITATION MAY NOT APPLY TO EVERY BUYER. THERE ARE NO WARRANTIES, WHETHER EXPRESS OR IMPLIED, WHICH EXTEND BEYOND THE LIMITED WARRANTY. THE LIMITED WARRANTY GIVES YOU SPECIFIC LEGAL RIGHTS, AND YOU MAY HAVE OTHER RIGHTS WHICH VARY FROM STATE TO STATE.
LIMITED WARRANTY IS NOT AVAILABLE IN CONNECTION WITH THE FOLLOWING, AND CANADIAN BOARD CO. MAKES NO WARRANTIES, EXPRESS OR IMPLIED, WITH RESPECT TO ANY OF THE FOLLOWING PRODUCTS:

• Products sold to someone under a different name than the name on the order;
• Products purchased from a seller other than CANADIAN BOARD CO.. For the avoidance of doubt, the limited warranty is available only for items purchased through the following channels: CANADIANBOARDCO.com
• Products purchased in bulk, with bulk discount.
• Products purchased for commercial use.
• Products purchased in used condition from CANADIANBOARDCO.com

LIMITATION ON LIABILITY

IN NO EVENT SHALL

CANADIAN BOARD CO. BE LIABLE TO YOU FOR A MONETARY AMOUNT GREATER THAN THE TOTAL AMOUNTS PAID OR DUE FOR THE PRODUCT(S) IN THE ORDER GIVING RISE TO SUCH LIABILITY. THE FOREGOING LIMITATION APPLIES EVEN IF THE PRODUCT FAILS OF ITS ESSENTIAL PURPOSE.
IN NO EVENT SHALL CANADIAN BOARD CO. (OR ANY REPRESENTATIVE OF CANADIAN BOARD CO.) BE LIABLE TO YOU FOR ANY SPECIAL, DIRECT OR INDIRECT, EXEMPLARY INCIDENTAL OR CONSEQUENTIAL DAMAGES, LOSS OF GOODWILL, LOSS OR EXPENSE RESULTING FROM THE USE OF OR INABILITY TO USE THE PRODUCTS OR THE PERFORMANCE OR NON-PERFORMANCE OF ANY OBLIGATION UNDER THESE TERMS, OR THE FACT THAT SUCH PRODUCTS DO NOT CONFORM TO THIS CONTRACT OR THE LIMITED WARRANTY, OR IN CONNECTION WITH THE USE OR AS A RESULT OF UNTIMELY DELIVERY EVEN IF SUCH PARTY HAS BEEN NOTIFIED OF THE POSSIBILITY OR LIKELIHOOD OF SUCH DAMAGES OCCURRING, AND WHETHER SUCH LIABILITY IS BASED ON CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, PRODUCTS LIABILITY OR OTHERWISE. THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF ANY REMEDY FAILS OF ITS ESSENTIAL PURPOSE.
SOME STATES DO NOT ALLOW THE EXCLUSION OF INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

PRODUCT WARNINGS

YOU ARE RESPONSIBLE FOR READING ANY PRODUCT WARNINGS AND INSTRUCTIONS THAT ACCOMPANY ANY ITEMS YOU PURCHASE FROM CANADIAN BOARD CO. CANADIAN BOARD CO IS NOT RESPONSIBLE FOR ANY DAMAGES RESULTING FROM YOUR FAILURE TO ABIDE BY SUCH PRODUCT WARNINGS OR INSTRUCTIONS. PLEASE USE ALL CANADIAN BOARD CO. PRODUCTS SAFELY AND RESPONSIBLY.Replacement of the warrantied product may be contingent on the return of the defective/warrantied item.
